Terms and conditions
These terms apply to the online ICAO language proficiency test, the individual preparation session, the PreCheck and the preparation + test bundle. They include information on the right of withdrawal, the model withdrawal form and access to the online withdrawal function.
Summary (does not replace the terms)
- Final prices including VAT. A surcharge applies to slots from 8 pm, at weekends and on public holidays (those of Baden-Württemberg, Germany): the calendar shows the amount and the total price before you book.
- Payment by PayPal, credit card or bank transfer.
- Free rescheduling or cancellation up to 24 hours before the slot; after that, the full fee is charged.
- Your level depends only on your performance in the test: no level is guaranteed.
- Consumers: 14-day right of withdrawal, model withdrawal form and online function “Withdraw from contract here”.
1. Scope
(1) These terms and conditions govern all contracts for ICAO language proficiency tests, individual preparation sessions (mock tests), PreChecks and the preparation + test bundle concluded between GAT – German Aviation Training, owner Tim Hittinger (“GAT”), and its customers (“the customer”). The version in force at the time of booking applies.
(2) A consumer is any natural person who enters into a contract for purposes outside their trade, business, craft or profession (Article 2(1) of Directive 2011/83/EU; in Spain, Article 3 of the consolidated consumer protection act, TRLGDCU).
(3) Terms of the customer that deviate from these do not apply unless GAT expressly agrees to them.

3. Services
(1) GAT organises and delivers the following services live by video call (Zoom):
- ICAO test Levels 4–6: assessment of English language proficiency under FCL.055 of Regulation (EU) No 1178/2011, open up to Level 6. Level 4, 5 or 6 is certified according to the performance shown.
- ICAO test Level 4 only: assessment with somewhat simpler tasks. The highest level certified is Level 4.
- Individual preparation (mock test): a 45-minute simulation of the test with assessment and feedback.
- ICAO PreCheck: a short 20-minute assessment.
- Preparation + test bundle Levels 4–6: one individual preparation session followed by a Levels 4–6 test. The person who prepares the customer does not examine them.
(2) The tests are conducted as the “ICAO Level” test of the language testing body LTB 112, based in Leonding (Austria), whose assessment method is approved and supervised by Austro Control GmbH, the Austrian aviation authority. LTB 112 carries out the second assessment and issues the certificate.
(3) The individual preparation session and the PreCheck are not a language proficiency assessment and do not replace the test.
(4) The language proficiency endorsement in the licence is made by the competent authority (for Spanish licences, AESA) on the customer’s own application. GAT does not apply on the customer’s behalf and has no influence on the authority’s decision or processing time. The authority’s fees are not included in the price. More in our AESA guide.
(5) To endorse an English language level, AESA also requires English radiotelephony (RT) privileges in the licence (section XII). The test does not grant these privileges.
(6) The service descriptions on the website explain what each service includes. None of them promises a particular test result (see section 9).
4. Booking and conclusion of the contract
(1) The presentation of services on the website is not a binding offer but an invitation to book.
(2) Tests, preparation sessions and PreChecks are booked in the online calendar of eTermin, our booking provider. The bundle is bought in GAT’s online shop, which is in German; the dates for the preparation session and the test are then agreed by email. No customer account is needed.
(3) Before the booking is completed, the calendar shows the service, date, time and total price, including any applicable surcharge. By completing the booking or purchase, the customer makes a binding offer. The automatic confirmation that follows only documents that the booking has been received.
(4) The contract is concluded: for payment by PayPal or card, when the payment is completed; for bank transfer, when the payment request is sent.
(5) The customer can book and communicate with GAT in writing in English or Spanish. The booking calendar and the shop may show some text in English or German.
(6) GAT stores the contract text and sends it to the customer with the booking confirmation by email. If the customer notices an error in their details, they can correct it before submitting the booking or afterwards by writing to info@german-aviation-training.de.
5. Prices and surcharges
(1) All prices are final prices in euros and include the applicable VAT. The price shown at the time of booking applies.
(2) Current base prices, VAT included:
- ICAO test Levels 4–6: €229
- ICAO test Level 4 only: €159
- Individual preparation (45 min): €69
- ICAO PreCheck (20 min): €19
- Preparation + test bundle Levels 4–6: €295
(3) A surcharge on the base price applies to slots from 8 pm, at weekends and on public holidays. Times in this clause refer to German time, which is the same as Spanish mainland time; in the Canary Islands they are one hour earlier (the weekday surcharge applies from 7 pm Canary Islands time). Public holidays are the official public holidays in Baden-Württemberg, Germany, where GAT is based, so they may differ from public holidays in Spain or in the customer’s region. The amount of the surcharge and the total price are shown in the calendar before the booking is completed.
(4) GAT vouchers are only valid for GAT services and are credited against the base price, not against surcharges.
(5) Fees charged by the authority for the endorsement (for Spanish licences, the AESA fee) are not included. The customer pays them directly to the authority.
6. Payment
(1) Payment methods: PayPal, credit card (processed by Stripe) and bank transfer.
(2) In the online calendar, the payment process must be completed within 15 minutes of booking. Otherwise, the slot is released again.
(3) With PayPal or card, the slot is confirmed immediately after payment. With bank transfer, once the amount has been received.
(4) If, for payment by bank transfer, the amount is not received within 10 calendar days of the confirmation being sent, GAT may cancel the booking.
7. Slots, rescheduling and cancellation
(1) Tests, preparation sessions and PreChecks take place online via Zoom. The customer receives the access details by email. Calendar times are shown in the time zone selected above the calendar (by default, that of the customer’s device).
(2) The customer can reschedule or cancel free of charge up to 24 hours before the start. After that, the full fee is charged and no refund is made.
(3) If the customer has not joined the Zoom meeting 15 minutes after the agreed start time, the entitlement to the service lapses without refund.
(4) If the customer is unexpectedly unable to attend, for example due to illness, they may name another person to take their place. This must be notified in writing (for example by email) no later than 12 hours before the slot.
(5) For the discounted bundle, its components cannot be changed or cancelled individually. Once the customer has used part of the bundle, the remaining part cannot be cancelled.
(6) The rules in this section do not limit consumers’ statutory right of withdrawal (see the information on the right of withdrawal).
8. Test rules
(1) Identification. At the start of the test, the examiner checks the candidate’s identity. An official photo ID (for example a national ID card or passport) is required, plus the licence if the candidate holds one. After booking, GAT asks by email for a copy of the ID and the privacy form, and sends a link for entering the candidate’s details in the test system.
(2) Technical requirements. The customer is responsible for a stable internet connection, camera, microphone, speakers or headphones and a quiet place. A computer or laptop is ideal; a phone or tablet also works. The customer should join 5 minutes early. Camera and microphone can be checked beforehand with our tech check.
(3) Own work, no aids. The candidate takes the test on their own. Help from other people and the use of notes, translators, artificial intelligence tools or other aids are not allowed. If the examiner detects a breach, they may stop the test; in that case no certificate is issued.
(4) Recordings. The customer may not record tests, preparation sessions or PreChecks – in particular by video, audio, shorthand or AI-based transcription and summarising systems – without GAT’s prior written consent.
9. Result and certificate
(1) The result depends solely on the performance shown in the test. GAT does not guarantee a particular level or a pass. In the Level 4 only test, the highest level certified is Level 4.
(2) Two assessors rate every test against the ICAO rating scale (Appendix 2 to Part-FCL). The overall level is the lowest of the six criteria. If necessary, Austro Control carries out a third assessment.
(3) The customer receives the result and certificate by email within 24 hours, usually on the same day, together with a copy of the assessment body’s approval by Austro Control. If a third assessment is needed, this may take longer.
(4) If Level 4 is not reached, GAT reports nothing to AESA or to the customer’s flight school. The customer can book again at any time.
10. Liability
(1) The customer’s statutory rights in the event of non-performance or defective performance apply.
(2) GAT is liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health.
(3) If the customer is a consumer, GAT is liable in accordance with the law. Nothing in these terms excludes or limits the rights granted to consumers by mandatory consumer protection rules.
(4) If the customer is a business, in the event of slight negligence GAT is only liable for breaches of material contractual obligations, and only for foreseeable damage typical of this type of contract. Otherwise, liability towards businesses for slight negligence is excluded.
(5) Decisions of AESA or any other authority on the endorsement, and their processing times, are outside GAT’s control. GAT is therefore not liable for them.
11. Data protection
GAT processes the customer’s personal data in accordance with the General Data Protection Regulation (GDPR). For the assessment and the certificate, it shares the necessary data with the language assessment body LTB 112; within the scope of official supervision, the data may be made available to Austro Control GmbH. 12. Language, governing law and jurisdiction
(1) The contract can be concluded in English or Spanish. These terms are available in both languages (versión en español). The booking calendar and the online shop may show some text in English or German (section 4(5)).
(2) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a consumer, this choice of law does not deprive them of the protection afforded by the mandatory provisions of the country of their habitual residence (Article 6(2) of Regulation (EC) No 593/2008, “Rome I”). For consumers resident in Spain, the mandatory rules of the TRLGDCU in particular continue to apply.
(3) If the customer is a consumer, the statutory jurisdiction applies: a consumer domiciled in the European Union may bring proceedings in the courts of their place of domicile and may only be sued there (Article 18 of Regulation (EU) No 1215/2012). If the customer is a business, the place of jurisdiction and performance is GAT’s place of business.
(4) GAT is neither obliged nor willing to take part in alternative dispute resolution proceedings before a consumer dispute resolution body.
(5) Should any provision of these terms be or become invalid, the remaining provisions remain valid.
Information on the right of withdrawal
For consumers. Wording based on the model instructions in Annex I(A) to Directive 2011/83/EU (in Spain: Annex I(A) TRLGDCU).
Online withdrawal function. As well as by letter or email, you can withdraw directly on our website. Fill in the form and confirm it: you will receive an acknowledgement of receipt by email without delay, showing the content of your declaration and the date and time it was received.
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us (GAT – German Aviation Training, owner Tim Hittinger, Max-Planck-Straße 22, 72810 Gomaringen, Germany, phone +49 7072 1352530, email tim@german-aviation-training.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
Start of the service during the withdrawal period and loss of the right
If you want the service to begin during the withdrawal period (for example because you choose a slot within 14 days of booking), your express request is required (Article 8(8) of Directive 2011/83/EU; in Spain, Article 98.8 TRLGDCU). For the right of withdrawal to end once the service has been fully provided, you must also acknowledge that you are aware of this consequence.
The right of withdrawal does not apply once the service has been fully performed, if performance began with your prior express consent and your acknowledgement that you would lose your right of withdrawal once the contract had been fully performed (Article 16(a) of Directive 2011/83/EU; in Spain, Article 103(a) TRLGDCU).
If you withdraw after performance has begun at your request, you pay the proportionate amount for what has already been provided, calculated on the basis of the total price agreed (Article 14(3) of Directive 2011/83/EU; in Spain, Article 108.3 TRLGDCU).
Preparation + test bundle
The components of the bundle cannot be cancelled individually (section 7(5)). This does not limit your right of withdrawal: if you withdraw within the withdrawal period, we refund what you have paid, minus – where applicable – the proportionate amount for what has already been provided at your request (for example a preparation session already held), calculated on the total price of the bundle.
